93-5 The Move Presents: Over the Top: Shows in Different Area Codes – Contest Rules
The “93-5 The Move Presents: Over the Top: Shows in Different Area Codes” contest (hereinafter: the “Contest”) is brought to you by Newcap Radio and tripcentral.ca, (hereinafter: the “Contest Organizers”). The Contest runs in Ontario from April 30th, 2018 at 8:00am Eastern Time (ET) to May 22nd, 2018 at 7:00am Eastern Time (ET) (hereinafter: the “Contest Period”).
This Contest is open to all persons residing in Ontario who have reached the age of majority as of the first day of the Contest Period. Notwithstanding the preceding, the Contest is not open to individuals associated with the Contest, including the employees, agents and representatives of the Contest Organizers, (including their respective divisions, subsidiaries, affiliates and agencies), their advertising and promotional agencies, suppliers of prizes, materials and services related to this contest or any other party directly linked to the holding of this Contest (the “Excluded Individuals”). This Contest is also not open to the immediate family members of the Excluded Individuals. For the purpose of these Contest Rules, “immediate family” includes: father, mother, brothers, sisters, children, legal or common-law spouse and individuals with whom such employees, agents and representatives reside.
HOW TO ENTER
During the contest period an announcement will be made on 93-5 The Move at the top of every hour between the hours of 8:00am ET and 8:00pm ET revealing an SMS keyword. Those to text that keyword and their name to 935935 will qualify for their entry included for the draw. Each keyword will be active for 60 minutes. SMS entries received after a keyword has expired, or those with the keyword spelled incorrectly, or those where the entrant did not include their name will not be valid and will not count as an entry towards the Grand Prize Draw. Standard text messaging rates from the entrant’s mobile provider may apply. The contest organizers will not limit the amount of times an eligible participant can enter, however the participant’s mobile/wireless provider may enforce a maximum number of entries.
On May 7th, 2018 (and May 14th, 2018, May 22nd, 2018) at approximately 7:00am ET, three (3) entries will be chosen at random from the valid SMS entries received. The name of each of the three entries will be announced on-air. The first of the three names announced to call 416-870-1935, successfully connect on the line with the on-air hosts, and provide the required information to verify identity will be declared a Grand Prize winner. The telephone lines will be completely locked until all 3 names are announced on air. In the event that the entrant is outside of the local calling area, standard long distance rates as charged by the entrant’s long distance service provider will apply.
If there is not a clear telephone connection between the 93-5 The Move on-air announcer and an eligible contestant, such that one or each other cannot hear the other, such eligible contestant will be disqualified, and the Contest Sponsor will not be liable in any way for such failed connection. While every effort will be made to keep the phone lines free, the contest organizers are not responsible if contestants receive a busy signal.
The odds of winning will depend on the number of total entries received during the contest period and the total number of individuals calling the Contest Line following the applicable Announcement.
There are three (3) Grand Prize available to be won, which includes:
- One-Way economy class airfare for two, Toronto (Pearson), Ontario to New York City, New York
- 3 nights hotel accommodation in a standard room in New York City (1 room, double occupancy) at a hotel of the contest organizers choosing
- 2 General Admission passes to see The Weeknd, Migos, Daniel Caesar on July 27th in New Yok
- 2 General Admission passes to see SZA, Gucci Mane on July 28th in New York
- $1,000.00 CDN (paid via cheque) for a shopping spree on Fifth Ave
- $200.00 CDN (paid via cheque) for dinner in Ne w York City
- $100.00 CDN (paid via cheque) for drinks/cocktails in New York City
- One Way Ground Transportation for two from New York to Philadelphia
- 2 nights hotel accommodation in a standard room in Philadelphia (1 room, double occupancy) at a hotel of the contest organizers choosing
- 2 reserved seating tickets to see Jay Z and Beyoncé on July 30th in Philadelphia
- A 30-minute helicopter tour of Philadelphia for two (**weather permitting)
- One-Way economy class airfare for two, Philadelphia, PA to Toronto (Pearson), Ontario
Grand Prizes will be awarded on May 7th, 2018; May 14th, 2018; and May 22nd, 2018. The approximate value of each prize is $7,000 CDN.
The following conditions apply to the Prize:
The prize must be taken as awarded otherwise it is NULL and VOID. Winner and gust must be able to legally enter the United States. The prize providers requires that all passengers travelling possess a valid Canadian passport valid for a minimum of 6 months beyond the dates of travel. Winner and guests must travel together. No changes will be permitted to any itineraries after bookings have been finalized. New York State law requires the winner and guest to be 21 or older in order to participate in certain elements of the Grand Prize. In the event a winner and/or guest is under the age of 21, the cash equivalent of that element of the Grand Prize will be supplied. Winner and guest may be required to sign an additional indemnity and release prior to boarding the helicopter tour.
All charges and expenses other than those mentioned above are the responsibility of the Prize winner and/or his/her guest namely, roundtrip transportation from the place of residence to the departure airport, ground transportation within destinations, personal insurance, meals, non-included taxes and gratuities, personal expenses, vaccines, as the case may be, passport and other fees to obtain required travel documents;
Subject to what is set out in the Contest rules, the winner and their guest must be available to travel between the dates of July 26th, 2018 and July 31st, 2018. The travel dates will not be extended.
If the Prize winner cannot accept the prize, for any reason whatsoever – e.g.: the winner does not hold a valid passport – he/she will not be entitled to any form of compensation and will not have the right to transfer the prize to another person;
If any part of the trip is not used, no compensation will be awarded to the winner or his/her guest;
A valid major credit card must be provided by the Prize winner or his/her guest for hotel check-in and incidentals;
It is recommended that the Prize winner and his or her guest obtain sufficient personal insurance prior to departure at their own expense;
Contest Organizers are not responsible for any other travel arrangements affected due to cancellation, changes or rescheduling of any dates and Sponsors reserve the right not to cover costs related to missed/delayed flights.
The Contest Organizers will not be responsible if weather conditions or other factors beyond the Contest Organizers’ reasonable control that prevent a Prize or part of a Prize from being fulfilled. Further, the Sponsors assume no liability or responsibility whatsoever should a Grand Prize winner or their respective guest be denied entry to the airline or concert for any reason whatsoever.
The Contest Organizers will not be responsible for cancellations of any performances included in the Prize. In the event a performance is postponed to a future date, that element of the Prize will be cancelled and the winner will not be entitled to any form of compensation whatsoever.
HOW TO CLAIM A PRIZE
In order to be declared a winner, each selected potential winner must be in compliance with these Contest Rules and in particular, the following:
The Contest Organizers must be able to reach the potential winner [by phone] within three (3) days of being announced as the winner.
Answer correctly the mathematical skill-testing question asked on a publicity release and liability waiver form (hereinafter: the “Release Form”) sent by the Contest Organizers;
Sign a publicity release and liability waiver form sent by the Contest Organizers and return it to them within three (3) days of receipt.
Provide the contest organizers proof of travel documentation (as well as their guest) no later than May 25th, 2018 at 10:00am ET.
By entering the Contest, each entrant agrees to abide by these Contest Rules. In the event the potential or declared winner fails to comply with any one of the conditions set out above or any other conditions set out in these Contest Rules, the Contest Organizers reserve the right to disqualify such entrant from the Contest and if time allows, a new draw for the prize will be held in accordance with these Contest Rules, until an entrant is selected and declared a winner, without affecting the order in which other prizes are awarded.
Verification. Entry Forms are subject to verification by the Contest Organizers. Any Entry Form which is incomplete, incomprehensible, inaudible, illegible, fraudulent, mutilated, altered, contains false information or is not received within the Contest Period, or otherwise does not confirm to these Contest Rules will automatically be rendered invalid and will not entitle such entrant to be eligible for a prize.
Disqualification. The Contest Organizers reserve the right to disqualify any person or cancel one or more entries of any person participating in this Contest or trying to participate by means contrary to these Contest Rules or in a manner which is unfair to other entrants (e.g.: use of an Entry Form obtained from an unauthorized source, entries exceeding the limit allowed, computer hacking, etc.). Any attempt to tamper with the entry process, interfere with these Contest Rules, deliberately damage any website or undermine the administration, security or legitimate operation of the Contest, is a violation of criminal and civil laws and the Contest Organizers reserve the right to seek damages and/or other relief from all persons responsible for such acts to the fullest extent permitted by law, which may include banning or disqualifying entrants from this and future contests. Such person may be referred to the appropriate judicial authorities.
Non compliance/eligibility. If a potential or declared winner is not in compliance with these Contest Rules, the Contest Organizers reserve the right to disqualify such entrant from the Contest and randomly select further entrants from the remaining eligible entries until a winner is finally declared. Any potential or declared winner who is not in compliance with these Contest Rules, must so inform the Contest Organizers immediately upon being contacted by the Contest Organizers.
Acceptance of prize. Prizes must be accepted as described in these Contest Rules and may not be transferred to another person, substituted for another prize, or exchanged in full or in part for cash, subject to the section below.
Substitution of prize. In the event it is impossible, difficult and/or more costly for the Contest Organizers to award a prize (or part of a prize) as described in these Contest Rules, the Contest Organizers reserve the right to award a prize (or part of a prize) of similar nature and equivalent value or, at their sole discretion, the value of the prize (or of the part of the prize) in cash.
Refusal of a prize. The refusal by a potential or declared winner to accept any prize awarded in accordance with the Contest Rules, releases and forever discharges the Contest Organizers and their agents of all obligations related to the prize, including delivery.
Liability limit – use of prize. Each entrant and any potential or declared winner releases the Contest Organizers, their subsidiaries, respective divisions, their parent corporations, their advertising and promotional agencies, their shareholders, officers, directors, employees, agents and representatives (hereinafter: the “Beneficiaries”) from any and all liability for any and all damage, loss or liability suffered as a result of or arising from the entrant’s participation in the Contest or the acceptance or use of his/her prize. In order to be declared a winner and prior to obtaining his/her prize, any potential or declared winner agrees to sign a declaration to such effect in the Release Form. The guest of the winner will also have to sign such a declaration to that effect in the Release Form, failing which they will not be able to take part in the Grand Prize.
Warranty. Any person selected for a prize acknowledges that the only warranty applicable to the prize is the standard manufacturer warranty.
Liability of prize supplier. Any person selected for a grand prize acknowledges that upon receipt of a letter confirming the prize, all services to be rendered in connection with their prize become the sole responsibility of the airline selected. A declaration to such effect will be included in the Release Form.
Liability limit – running of the contest. The Beneficiaries are not liable for faulty computer components, software, or links; the loss or non-existence of communications capability; or faulty, incomplete, incomprehensible, or erased computer or network transmissions that make it difficult, or render a user unable, to enter the contest; problems with any website or website feature howsoever caused, the malfunction of, or damage caused to, any telephone or network or lines, computer equipment, data or software, online systems, servers or access providers; or the security or privacy of information transmitted via computer networks; or for breaches of privacy due to interference by third party computer “hackers” The Beneficiaries are not liable for any harm contestants may suffer directly or indirectly as a result of downloading any Web page or software or transmitting any information related to entry in the Contest.] Further, the Beneficiaries assume no responsibility for entries lost, stolen, delayed, damaged or misdirected.
Modification. The Contest Organizers reserve the right, at their sole discretion, to cancel, terminate, modify or suspend this contest, in whole or in part, in the case of the occurrence of an event, an error or any human intervention that could corrupt or affect the administration, safety, impartiality or the running of the Contest as provided in these Contest Rules.
[Early termination of the Contest. In the event that the computer system cannot record all the Contest entries during the Contest Period for whatever reason, or if participation in the Contest must be terminated in whole or in part before the closing date of the Contest as per the Contest Rules, the Contest Organizers will proceed with the draw among entry forms duly registered during the Contest Period or, as the case may be, up to the date of the event that lead to the termination of the Contest.]
Limit of prizes. In no event shall the Beneficiaries be obligated to award more prizes than set out in these Contest Rules or to award prizes otherwise than in compliance with these Contest Rules.
Impossibility to act – labour dispute. The Beneficiaries shall not be responsible for any damages for a failure to operate the Contest in accordance with these Contest Rules in any case where their incapacity to act results from circumstances or a situation beyond their reasonable control or because of a strike, lock-out or any other labour dispute in their company or those of businesses which services are used for holding this Contest, war, riot, insurrection, earthquake, terrorism, civil commotion, fire, flood, accident, storm or any other act of nature.
Liability limit– participation. Any person who participates or tries to participate in this Contest releases the Beneficiaries from any and all liability for damages which he/she could suffer from participating or trying to participate in this Contest.
Authorization. By entering this Contest, each declared consents to the Contest Organizers and their representatives to use, at their sole discretion and if required, their name, photograph, likeness, testimonial related to the prize, place of residence and/or voice without compensation whatsoever and that, without limit as for the period of use, in any media and on a worldwide scale, for publicity purposes or for any purpose that may be considered relevant. A declaration to such effect will be included in the Release Form.
List of winners. From May 23, 2018 – May 24, 2018 the names of the winner will be available at the office of the Station Monday to Friday from 8:30 a.m. to 5 p.m.
[Property of entries. Entry Forms are the sole property of the Contest Organizers and at no time will be returned to entrants. ]
Communication with entrants. No communication (other than while registering) or correspondence will be exchanged with entrants in the context of this Contest with the exception of selected entrants or declared winner.
Personal information. Contestant personal information that is collected in this Contest will be used solely by the Contest Organizer and their representatives for the administration of the Contest. There will be no communication of commercial or of any other nature, unrelated to this Contest sent to an entrant, unless such entrant gives specific authorization to the Contest Organizers for that specific purpose.
Decisions of the Contest Organizers. All decisions of the Contest Organizers or those of their representatives regarding this Contest are final and binding.
Identification of the contestant. For the purposes of these Contest Rules, the entrant is the person whose personal information is printed on the Entry Form. It is to this person [that the mathematical skill-testing question will be asked] and the prize awarded if selected and declared a winner.
Unenforceability. If a section of these Contest Rules is declared or ruled by a Court of Law as illegal, unenforceable or void, that section will be deemed void but all other sections not affected will be enforced as allowed by Law.
Jurisdiction. This Contest is subject to all applicable federal, provincial and municipal laws.
